BREAKING: Ellis Hearing Officer Recuses

Charles McClelland recused himself as hearing officer from the Jackson Public Schools administrative termination hearing for Chastain Principal Michael Ellis this morning.

"Mr. McClelland's recusal is due solely to the personal attacks made on him by certain attorneys in this proceeding," said McClelland attorney Robert Wilkins. "McClelland is adamant that he did not violate any laws whatsoever."

Lisa Ross, who is Ellis' lead attorney, had insisted that McClelland should recuse himself because his business, McClelland Moving and Storage, does business with JPS, which she said was a conflict of interest. Ross had vowed to take the matter before Hinds County Chancery Court and even the state Supreme Court if McClelland did not recuse himself.

McClelland's recusal may mean that the hearing, which has already run more than 40 hours, will have to start over from the beginning.

Better late than never. McCelland might be an honest and great person; however, it is hard to believe that a fair and impartial decision could be rendered with such high steaks in play. His continued presence in this case would have given the appearance of impropriety - real or imagined.
