[Verbatim announcement] At 10 a.m. on Monday, January 12, 2009, the Mississippi Supreme Court will sit en banc to hear oral arguments in the case of the City of Jackson v. Byram Incorporators. The City of Jackson has appealed the chancellor's ruling in favor of Byram's incorporation, arguing that the Byram incorporators did not obtain the signatures of two thirds of the qualified electors, which is necessary for an incorporation petition to be filed. The City also appealed the denial of its petition to annex the Byram territory, arguing that the area is within its path of growth. This case is widely thought to be the one of the most significant case before the new Supreme Court (now led by Chief Justice Waller and presiding Justice Graves) and the outcome may have a profound impact on the future growth of the City of Jackson.

Jim Carroll and Chad Mask of Carroll, Warren and Parker will argue the case for the City of Jackson. The argument will take place in the en banc courtroom of the new Gartin Justice Building. Anyone interested in the future of Jackson should attend. The new courtroom is absolutely beautiful and there is ample seating for the public. jackson was in fact granted some additional territory, a parcel northwest of the city, a parcel southwest of the city, and about four square miles of land south of the city that the byram oncorporators were seeking to include.

I grew up in Byram and this case is important to me. Simply put, if people don't want to be in a city, I don't think they should have to be. Jackson would do well to look inwards and improve services and administrative competence before thinking it possible to annex additional land and citizens.

Danks is not listed as counsel on the appeal brief.he did try the case with his then law partner jerry mills,who is representing the byram folks in the appeal and will argue the case on monday.
