Sheriff Malcolm McMillin has confirmed to the Jackson Free Press that Judge Tomie Green has issued a warrant for the arrest of Mayor Frank Melton. Green issued the arrest warrant March 1 in response to Melton violating the terms of his probation. In November, Melton pled guilty to misdemeanor weapons violations and was sentenced to six months in the Hinds County jail. That jail time was suspended so long as Melton honored the terms of his probation, which included a nighttime curfew.

McMillin said Melton violated his probation during his Feb. 11 raid on the Upper Level nightclub, first reported by the Jackson Free Press. Melton has insisted that he asked for and received permission to conduct the raid the afternoon of Feb. 10, but his probation requires him to seek permission 48 hours in advance.

WAPT has reported that Dennis Grant of Probation Services Company told a WAPT news producer that Melton had not had permission to conduct the raid. Grant has since declined to comment.

McMillin also said that Melton has failed to account for extra days he spent in Texas seeking medical care. After receiving a report from Grant (PDF, 108 KB) expressing concern about possible probation violations by Melton, Judge Green wrote Melton on Jan. 31 requiring him to submit certification from his cardiologist confirming his entry and release dates from the hospital.

McMillin said that Melton will likely be held over the weekend and will probably have a hearing next week. The sheriff said he will treat the arrest warrant like any other warrant. "It's not too hard to follow these probation orders," McMillin told the Jackson Free Press. "If you need to adjust to schedule conflicts in your order, then you just talk to your probation officer and make whatever changes you need to. It's a matter of the kind of personality you're working with."

Melton is also out on bond for five felony convictions for allegedly leading a demolition raid on a Ridgeway Street duplex. The Jackson Free Press broke that story on Sept. 1, 2006, which was followed by grand jury indictments two weeks later. Melton and his bodyguards will stand trial on those charges in April. UPDATE: About 6:30 p.m., as reporters waited outside Melton's gate at 2 Carter's Grove in North Jackson, the gate opened and a car roared past. Melton, apparently, was en route to St. Dominic's where he checked in due to chest pains. His attorney Dale Danks told the media that his cardiologist in Texas asked the hospital to admit him. He is expected to turn himself in to Sheriff McMillin Saturday.

I'm a witness that a panic attack feels like a heart attack, so maybe he just freaked out, but this does look like he's evading arrest. I wish that St. Dominic could reveal whether or not there was actually something wrong with him, but because of HIPAA regulations, you can't share health information without the patient's consent. Of course, I don't think Melton would consent to it. If anything, we'll get a "version" of what happened by a person of his choosing.

For the record, the Ledger tonight is reporting inaccurate information: The first-term mayor had been accused of carrying a gun Feb. 28 onto the campus of the Mississippi College School of Law, a felony. He also had been accused of two felony counts of carrying a concealed weapon into a church. Uh, Ledge, Melton was charged and convicted of two misdemeanors—one for carrying a gun into St. Andrews, and the second for carrying a gun into Jaycee Park. Not felonies, you rubes. If Mr. Melton was having chest pains, it was perfectly appropriate to take him to St. Dominic's. That would provide some explanation for why his car shot out from behind the gate as it did. I swear, all of us reporters jumped back in fear of getting hit, and then the car accelerated down Riverwood at incredible speed. At the time, it seemed like defiance, but apparently it was a medical emergency. Mr. Melton will not get out of being arrested by spending an evening in the hospital. They will make sure he is stable and then he will turn himself over to the sheriff. It is not necessary to arrest him in the hospital. He is not going anywhere. That said, Mr. Melton should resign, for his own health and for the sake of the city. He should never have gone on a raid just a couple of weeks after open heart surgery. If he had been at home, resting and recuperating as his doctors surely directed, he would not have violated probation and would not be facing arrest. He would not be in a hospital now if he had not insisted on that extremely foolish raid. If I were a family member, I would beg him to resign, take a plea that keeps him out of jail, and spend at least a year at home recovering. I don't think he's faking his chest pains. I think he has been so bull-headed (as my mother would say) that he's put his own life in jeopardy.

Also, if the Ledger reported this correctly—who knows?—then it's interesting that Danks seems to be confirming what we've long been told: that Melton has to wear an ankle monitoring bracelet: Danks lashed out at Melton’s treatment, saying the mayor had done everything in his power to make sure he does not violate his probation, including turning over medical records and wearing a motitoring (sic) device on his ankle. Not sure who his cardiologist is but have heard that he has been going regularly to a cardio unit at St. D for therapy. Notice that Dr. Smith hasn't uttered one word as to Melton's condition. He just stands in the background which sends a strong crediblility signal to a lot of folks in Jackson. Dr. Smith has been practicing in West Jackson for over 40 years, traveled the state in the 60s providing care, was the first African American chief of staff at Hinds General (now CMMC) and served on the Board of WLBT when Dr. Aaron Henry was alive and Melton was general manager. These are the subtle signs that bolster Melton supporters.

I think some people will try to say some of us are being crass for dogging Melton during tonight's events. The press was speeding after him as he rushed from home to hospital. I'm sure some will call it a circus. Yet, it should be noted that the Sheriff could have gone to his house or waited till he had word he was at City Hall, and arrested him in cuffs in front of all to see. I am happy that the Mayor has focused our attention on the necessity for steady and measured leadership. I am happy that he has made the poorest sectors of our city his priority. After seeing that black 300 speeding like that I thought the KGB's were coming. I locked the door and grabbed my revolver and a razor blade. I could be wrong, but I got the idea he was running from McMillan and the deputies, not to any hospital. If a medical emergency, an ambulance or the copter could have been called for a man of his significance. Jail is a scary prospect for the rich, mighty, famous and poor. Hell, many of us would have had a panic attack when about to respond to "what you gonna do when they come for you, bad boy, bad boy?" I wish the maya good health too, and if I were Judge Green I wouldn't grant a hearing until he has sat in jail a few days. I have sympathy for his health but am not opposed to his going to jail for days or months since he can't seem to conform to the rules and laws of this jurisdiction and country. However, accusing Cliff of not caring about—or working for—Jackson is simply absurd. What I find interesting is that the report to the Judge came from PSC and not the AG. Any word from the AG as to why he didn't wish to pursue? Can the JFP get a copy of the report sent to Judge Green? If you can, can you look at how the facts compare to the probation, as well as the bond? Two different judges, but it appears for the most part the conditions are quite similar for both probation and bond.

As I understand it, either probation services or the prosecution can initiate and present actions to revoke probation. I have seen the two do it in conjunction with each other and seperately. Just last week in Kosciusko I saw a probation officer presenting a case for revocation. He won too.

There are other major issues that need to be investigated by the Federal Government and State Law Enforcement officials. The first is the City of Jackson Legal Department, the next are members of the Jackson City Council, but this investigation should also look into the hiring and illegal terminations of City of Jackson employees by the CAO Robert Walker and the City of Jackson Personnel Department. It time to put the blame on the real cuprits in City of Jackson. There will be several lawsuits filed against the City of Jackson at the taxpayers expense while certain members of the City of Jackson Legal Department get rich at the taxpayers expense. The citizens of Jackson should demand a federal investigation into mispent funds, civil rights violations and harrassment of employees. The City of Jackson has all the resources and talent to be a great city the problem is that we have several department heads and council members that believe thy are the mayor of the City of Jackson. The example that I local officials throught their constant bikering, accussations and their own violations of the law is the reason why crime is on the increase. The Jackson City Council and several of the City of Jackson Department heads feel they can violated the law while pointing the finger at someone else. Why should our children obey the law when everyday our City Council and department heads show their disrespect to the citizens of Jackson and to the State of Mississippi. I wish that the Jackson Free Press would investigate and report the factsd on Bids awared to certain contractors, Federal Grant Funds being used to provide additional income to salary employees and their relationship with certain council members. When this is exposed then we can address the real criminals in City Government.

Kamikaze, I don't think anyone is saying that Cliff is a white hero sweeping down on the ghetto to help the helpless black folk. However, if you've talked with Cliff (and I have), he is rather eloquent on the subject of how race has been cashed out in the Melton controversy. He is not the first to point out that Melton would never be able to get away with such shenanigans if he were white, but he is constantly doing battle with the Northeast Jackson set trying to make them see that fact, that Melton has provided white people with a comfortable way of being racist all over again. He has also argued to the point of exhaustion that conservatives should be the people most outraged by Mr. Melton's demolition of the Ridgeway duplex because conservatives have always stood for the sanctity of property rights. In other words, if this was your rental duplex, fellow Republican, how would you feel? It's not that Cliff is a hero, but his is a voice that white conservatives from northeast Jackson will actually hear. He has used that position to challenge their assumptions, especially about race. He certainly deserves credit for that.

Let's face it, lots of people are afraid to go to jail. I can't count the number of people who have broke down crying to me and others and declaring they just can't do any time yet won't stop committing crimes. I don't really understand it as it's so clear that continual crimes or ignoring rules lead to prison or jail. About 10 year ago, a 75 year old was sentenced to 25 years. He said to the judge "I don't think I'll make it that long" and the nice judge said "just try, just try." Moments later a one-legged female got life and hit the floor like cut timber (she fainted). Parchman correctional officers got her back together and drove her on to prison. I don't blame Frank for hauling ass. A many good men and women would have too. Sho Nuff, and that's the truth, Ruth!

I'm unhappy that everything that man had was destroyed and he was arrested without a warrant by someone who claims he's a law enforcement officer. Melton is just off on several fronts, but the disturbing aspect of it is that so many people are willing to overlook his afronts to the law because they agree with his tactics. I am black and have lived in black and white neighborhoods and there is a distinct difference in how law enforcement behaves. A lot of people that support Melton and his tactics/antics would not go for it happenning in their neighborhood. It seems like they have a lower level of respect for black people. You can not enforce the law while breaking it. I was thinking about profiling the other day and it dawned on me that the only time we talk about profiling a group of people is when it involves a minority. Maybe a white person can explain this to me, but the need to profile never comes up unless the perpetrators are non-white. Before 9/11 we had terrorists, but we never profiled for them. Group profiling usually means harassing and abusing innocent people while occassionally catching a bad guy. I got off on that tangent to say that if people like Larry Nesbit, who profess to be Christians would treat people as they wish to be treated, we wouldnt have a Frank Melton problem or issues like racial profiling. People of all races want to fight crime and have prosperous communities, I just refuse to believe that to achieve that you have to forfeit civil rights. If I am wrong, someone please straighten me out.

The real crime is when our elected officials use their positions to get media attention and attack each other for their own personal glory, while we have people that need jobs, decent home, medical care, education and self respect. Everyone wants to be the judge and the jury, yet we are all afraid of letting people now our own insecurities but when it is placed in the media we all have opionions. Let's not judge, anyone that does wrong will anwer for their own sins on judgement day. I know one thing, I not planning on going to hell for no one!!! Frank Melton it's time to get rid of the problems in your administration, it's also time to rebuild bridges between all the individuals that you have wronged and its alright to humble yourself in order to heal this City. Mayor Frank Melton is a living example of what we need to fix in the city of Jackson. The justice system that we have been told over and over again is broken “WE NEED MORE JAILSPACE,” “WE NEED MORE POLICE OFFICERS,” or “WE NEED MORE JUDGES,” really works in regards to crucifying Melton. The criminals in Jackson have gone to extremes to ensure that a lawless city would succeed and their wishes are being granted now. Is it the greater benefit to meet the thugs on their battlefront or fight fire with fire in order to preserve what little the city has left? Once again the media proves to be the scumbags of all eternity in a time where people have lost almost all respect for journalism as a whole. With the decline in readership, subscriptions, and ratings, I wonder when the gatekeepers will ever be able to recognize why so many are turning a deaf ear to these ongoing social critics. Our Mayor may be on his way to jail (I doubt it), but in the long run it only proves to us all the city’s own hypocrisies and inconsistencies.

Skinny, the other day I spoke with a young black man who'd been stopped several times in Madison County by a police officer because, according to the officer, he was black in a white neighborhood and thus might be selling drugs. I'm sure the officer considered the stop an example of meeting "the thugs on their battlefront". But we don't allow this because we insist that the government follow the rules, which are the constitution and the law. We have these rules to protect citizens such as you and me from government thugs such as that officer and our mayor.

Under Mayor Harvey the cops would stop you in certain parts of town if you were white. NOW I don't blame them one damn bit. If you were white in certain areas, the chances were higher that you were probably there buying drugs, especially after dark when there was little regular business to be done. We got stopped going out to get rent money but that didn't bother me at all. Cop was just doing his job and acting on what his experience had taught him to look for.

Racial profiling is certainly expedient. So is wiretapping phones and opening mail. There's really no end of government surveillance and control that wouldn't help stop crime. Ruby Ridge and Waco are also fine examples of expediency in crime fighting. One of the very reasons we have a constitution is to protect us from governments who would use expediency as a reason to restrict freedom. Want to curtail anti-American teachings in the name of preserving the peace? Delete the 1st Amendment. Ban guns for safety? Get rid of the 2nd. Soldiers need a place to sleep? Get rid of the 3rd. Want to search young black men's cars in the war on drugs? remove the 4th. Compel defendants to testify against themselves? Erase the 5th. And so on. It's all very, very expedient. Fortunately, it's also a violation of the rules we set forth at the founding of our country in order to protect us from the government's love of expediency over freedom.

Whatever is done with Mr. Melton should be done with the greatest care possible. I would hate to see him martyred, as becoming a cause celebre could make him even more harmful to Jackson. Having said that, it would be best if Melton could see for himself that his antics have not helped Jackson. Perhaps one day soon, his front door will be marked with GTT...Gone To Texas. If only....

Brent, I expect cops to use their experience in making judgements. If I'm over on wood street after midnight and I am white, I am probably up to no good. If I'm a cop who knows that area pretty well, then it would get my attention. That is all I'm saying.

I think it is a joke that when you ride by the Convention Center construction sign downtown it says, "Frank E. Melton, Mayor" He is the lest deserving of having their name attached to the Center in nay fashion, except that he is mayor. Ben, Margaret, Crisler, and even Stokes' name would look better at the top than Melton's!

I think we just amicably disagree on this. Piker, do you know if the custom of attaching the mayor's name to everything--from construction sites to the airport--is recent? Brent, it is very much the rule of thumb to have your mayor and councilmembers listed on construction signs and plaques for public type projects like the Convention Center. Whoever is in office at the time gets listed. I'm sure Louis Armstrong is on some for example. It's just with the Convention Center, if anyone had next to nothing to do with it becoming reality, it was Melton. But, the protocol is what it is. I'm just eating sour grapes.

To give you an idea of how delusional Frank's supporters are (as if we didn't already know...at the end of Sunday's Straight Talk show on WOAD, Bob Hickingbottom suggested that people call Congressman Bennie Thompson and have him to get Tomie Green to overturn the arrest warrant and even recuse herself from the case. First, what business is it of a Congressman to interfere in a court case? Sounds like borderline influence peddling to me. Second, Judge Green is following the law. If any person violated the terms of his or her probation, they would surely go to jail. The same should apply to Frank and any other public official in such a situation. Last but not least: if Judge Green even considered allowing Thompson to interfere in the case, her law license should be immediately revoked. These people will stop at nothing to protect Frank.
